Samantha Markle’s Defamation Lawsuit Against Half-Sister Meghan Markle Has Been Dismissed

Before Meghan Markle and Prince Harry told THEIR TRUTH in a multi-part Netflix docuseries, his memoir Spare, and to anyone who puts a mic in their faces, they told THEIR TRUTH to Oprah in 2021. During that interview, Meghan said she was raised as an “only child.” Well, Samantha Markle, daughter of Meghan’s father, Thomas Markle, and Meghan’s half-sister, used that to file a defamation lawsuit a year ago. Samantha’s lawsuit claimed that Meghan was telling lies when she called herself an only child. A few months after the lawsuit was filed, Meghan’s lawyer filed to dismiss it, saying that Meghan was talking about her own impressions of her own childhood. And in February, it looked like the judge was going to throw Samantha’s lawsuit out. That’s what happened this week.

Long before Samantha filed her lawsuit against Meghan, her full-time job had been dragging her half-sister, including writing a book titled The Diary of Princess Pushy Sister. In her lawsuit, Samantha claimed that Meghan’s “false narrative” of her upbringing subjected Samantha to “humiliation and hatred.” via The New York Post:

Samantha, who shares a dad with the exiled royal, claimed Meghan “orchestrated the campaign to defame and destroy her sister’s and her father’s reputation and credibility in order to preserve and promote the false ‘rags-to-royalty’ narrative [Meghan] had fabricated about her life to the Royal Family and the worldwide media.”

Samantha’s lawyer Peter Ticktin told the court that Meghan got caught in a lie about her upbringing and decided to slam her half-sister and estranged father to cover it up, according to the Daily Mail.

“Why else is she putting her sister down? Why else is she putting her father down? Why else is she denying her family who has done nothing but good to her all her life?” Ticktin said. “She never had a problem with them at all.”

He said the “false narrative” put out by Meghan harmed his client.

Meghan’s side argued that it’s her First Amendment right to voice her opinion and “even criticize.” The judge sided with Meghan and granted her motion to throw the lawsuit out since you can’t really punish someone for recounting their childhood, according to the New York Post: 

But on Thursday, a Florida judge didn’t see it that way and dismissed the lawsuit, saying Meghan’s remarks were opinions and “not capable of being proved false.”

“As a reasonable listener would understand it, Defendant merely expresses an opinion about her childhood and her relationship with her half-siblings,” US District Judge Charlene Edwards Honeywell wrote in her order.

“Thus, the Court finds that Defendant’s statement is not objectively verifiable or subject to empirical proof. Plaintiff cannot plausibly disprove Defendant’s opinion of her own childhood.”

“A reasonable person…” On Twitter, an attorney for the self-proclaimed “MAGASammy,” said that the entire case was not dismissed and she will refile:

It’s a mystery as to where Samantha is going to get the money to keep this totally-not-frivolous lawsuit going. I would say that she could always hit up her idol Trump for some money, but he’s got his own legal mess to deal with…
