The Civil Case Against Danny Masterson Has Been Ordered To “Religious Arbitration”

Accused rapist Danny Masterson has an arraignment scheduled for Wednesday, January 6th to face criminal charges for allegedly raping three women, Chrissie Carnell Bixler and two Jane Does. For those charges, he’s facing a sentence of 45 years-to life if convicted. He’s also fighting a civil case brought by those women, plus another, Marie Bobette Riales. However, with the help of a rich, well-connected uncle named David Miscavage, People reports that the civil case has been ordered to “religious arbitration” because Chrissie and the Janes Doe all signed something when they were members of COS. Tony Ortega reports at The Underground Bunker, just how fucking sinister that ruling is.

According to People, the civil case against Danny doesn’t include allegations of rape as the criminal case does. Instead, Chrissie, the Janes Doe, and Marie all accuse agents for COS of stalking and intimidation (including the alleged poisoning of Chrissie and her husband Cedric Bixler-Zavala’s dogs) as a result of reporting Danny to the police.

The civil lawsuit — initially filed in Aug. 2019 by Chrissie Carnell Bixler, her musician husband Cedric Bixler-Zavala, Marie Bobette Riales and two Jane Does — claimed that the Church’s agents stalked and intimidated them after they reported allegations against Masterson to police.

In Los Angeles County Superior Court on Wednesday, Judge Steven Kleifield ruled that the civil complaints against the That ’70s Show actor must be resolved through in “religious arbitration” due to an existing arbitration agreement among the involved parties, according to the court order.

In response to the court order, which set the status conference on the new arbitration for June 30, Masterson’s attorney Andrew Brettler tells PEOPLE, “This was absolutely the correct result. We look forward to arbitrating the claims, as the Court directed.”

In the suit, Carnell Bixler claimed Masterson sexually assaulted her multiple times while they were dating in 2001 and 2002, Variety reported.

After Carnell Bixler reported the sexual assault to police, Bixler-Zavala alleged in the lawsuit, “agents of the defendants” poisoned their dogs, assaulted them with cars and made harassing phone calls.

Jane Doe #1 claimed she suffered property damage, violent threats, assaults and sexual harassment after reporting the alleged rape to police, Variety reported.

The lawsuit also included Jane Doe #2, who claimed that the defendants inflicted emotional distress, stalking and invasion of privacy, according to the outlet.

Valerie Haney, who filed a lawsuit against Scientology citing a litany of human rights violations, was similarly ordered to religious arbitration last year. As Tony Ortega points out, the term “religious arbitration” doesn’t sound so different from regular arbitration where one might get together in a room with an impartial 3rd party and hash things out. However, in Scientology, there is no impartial 3rd party, but the specter of L.Ron Hubbard is allowed to sit in the corner wheezing and laughing his ass off at the proceedings.

Scientology’s brand of “religious arbitration” does not involve an independent arbitrator. It’s a kangaroo court featuring three arbitrators who have to be members of the church in good standing and are prevented by Scientology policy from being fair to ex-members like these women who are considered excommunicated, or declared “suppressive persons.”

Here’s Chrissie’s reaction to the ruling. She says as a Scientologist, she had to sign things she wasn’t allowed to read whenever she began “a service.”

According to TUB, the only other time religious arbitration was actually conducted, the plaintiffs reported that they “were not allowed to have an attorney with them, no recordings were allowed, no transcript was produced, and most of the documentary evidence the Garcias brought with them was not allowed to be entered by Scientology’s “International Justice Chief,” Mike Ellis.” They sure do like just making up lofty titles for themselves! I’m going to start calling myself “Intergalactic Queen Supreme” and see where that gets me.

What’s worse, despite the fact that all of the women involved in the civil suit have protective orders in place against their alleged rapist, Danny’s allowed to join in on the arbitration sessions. Naturally, Danny’s accusers have argued against this citing “Marsy’s Law” which is supposed to protect people from having to face their alleged assailant in court. Even worse, Danny’s presence could jeopardize the criminal case against him!

The very next day attorneys for the women brought up Marsy’s Law in court papers, and also brought it up in a court hearing held December 18.

But in his ruling, Kleifield swept away those concerns with a single line:

“Masterson does not object to participating in the arbitration and may therefore participate.”

Not only is it stunning that these women would be asked to participate in Scientology’s one-sided proceeding with the man they say violently raped them, but anything said in such a setting could actually jeopardize the criminal case.

“I would think that the DA would need to take some action,” Ray Jeffrey tells us, agreeing that it makes no sense to jeopardize a criminal proceeding with Scientology’s “arbitration” farce.

Think about it, the COS is going through all this to trouble to save Danny’s washed-up hobo-looking ass (they even got him Tom Mesereau, the man who got Michael Jackson off the hook for alleged child molestation, to represent him in his criminal case), imagine the lengths they’d go to protect someone like Tom Cruise. There really is power in those silly made-up titles. So shit, let me shoot my shot.
