Kelly Rutherford Brings The Melodrama In A Statement About Her Kids Being Sent Back To Monaco
I feel like every time I write about this disaster of a case, I have to repeat the history of it for those of you who don’t know. Well, if you don’t know and care, you can read an easy-to-read and pretty comprehensive rundown of the case at Jezebel, or just watch a car crash compilation video on YouTube since that pretty much sums it up.
Yesterday, Manhattan court judge Ellen Frances Gesmer ordered for Kelly Rutherford’s kids to be put on a plane back to Monaco to be with their father Daniel Giersch. Kelly’s children were staying with her in NYC for the summer and she was supposed to return them to Europe last week. She didn’t, so she was dragged into a Manhattan courtroom where Judge Ellen refused to hear anything she had to say and turned the children over to Daniel’s mother who took them back home to Monaco. Daniel’s lawyer said that the entire scene was calm and civil. Daniel’s lawyer claims that the children, Hermes and Helena, kissed their mom goodbye before joining their memaw.
But in a statement she released today, Kelly makes it sound like her kids were screaming and crying as police officers tasered them, handcuffed them and threw them into a paddy wagon. Kelly says that Judge Ellen basically arrested her kids and that the judge is the one who should be put into handcuffs for committing child abuse. Kelly says that it was the cruelest act against a child she’s ever seen. I guess Kelly doesn’t know that Pete Wentz named his kid Saint Lazslo, because that’s a real cruel act against an innocent child.

Kelly Rutherford was ordered to show her face in a courtroom in NYC this morning after she refused to send her two children, Hermes and Helena, back to Monaco where they live with their dad Daniel Giersch. Kelly got to keep her kids in NYC for the summer, but when it came time to put them on a plane to Monaco, she said “fuck no” and kept them. Both California and New York rejected Kelly’s custody case, because they say that Monaco has jurisdiction. Kelly argued that since no state in the US has ordered her to return her children, she’s going to keep them and will not send them to Europe. Well, that changed today, because a court in NYC did order her to send them back to Monaco.
Kelly Rutherford’s Ex Is Accusing Her Of Kidnapping Their Children
Those of us who thought that the train wreck custody battle between Kelly Rutherford and her ex-husband Daniel Giersch would eventually become a reboot of Not Without My Daughter were right when she refused to return her kids, Hermes and Helena, back to their dad in Monaco. As part of their custody agreement, Kelly got the kids for the summer in NYC and she was supposed to ship them back to their daddy, but she didn’t.
Daniel’s US Visa was revoked a while ago, but Kelly says that he can use his German passport to come to America to “exercise his parental rights” just as she has done in France and Monaco. So, Hermes and Helena are still in NYC and now their dad is calling Kelly a shameless kidnapper. It’s times like these when I want to thank my dad for busting out on us instead of turning me into a tug ‘o rope by getting into a disaster of a custody fight with my mom. Yes, I’m fucked up, but I may have turned out even more fucked up (yes, that’s possible, I think) if my parents pulled a Kelly and Daniel.
Kelly Rutherford Didn’t Return The Kids When She Was Supposed To
Real life embodiment of Not Without My Daughter (in HER mind), Kelly Rutherford decided to issue a “fuck y’all!” to the courts this week by not returning her kids to her ex in Monaco. If you’ve been following this mess, the hooker with a heart of gold from Melrose Place has been locked in a crazy custody battle for her son and daughter. Rutherford has even cried out for Obama to set the “not right” to “right” on her behalf. I don’t think he got back to her.
Kelly’s kids stayed with her in NYC for the summer and she was supposed to put them on a plane headed for their dad Daniel Giersch in Monaco on Thursday. She didn’t. Despite them having joint custody (as determined by a California judge), they have lived in Monaco with him full time since 2012 due to his US visa having been revoked. People reports that Rutherford has issued a statement explaining why her kids won’t be returning to their dad’s place in Monaco per court order.
“These past three years waiting for my children to come home have been very difficult. My children were forced to leave the United states in 2012 when they were only 2 and 5 years old. In May, a judge in California gave me sole custody and brought them home. I am immensely grateful and overjoyed to have them back. Since May, however, the court proceedings have been confusing.”
I’m not sure pleading “confused” is the way to go. Is that the defense known as “dumb blonde?” Megan isn’t THAT confused because she’s determined that, since neither California nor New York are claiming jurisdiction over Hermes, 8, and Helena, 6 – the State of Rutherford will.
“The fact that neither state is claiming jurisdiction means no state in this country is currently protecting my children. It also means that no state in this country currently requires me to send the children away. Hence, I have decided that I cannot lawfully send my children away from the United States to live in a foreign country.”
Obviously this story isn’t over. I’m a little confused, too. What I’m not confused by is that expression on Hermes’ face. The one that says, “Can I just go live with an aunt or something because this is a mess?” The pup obviously feels the same, Hermes.

Kelly Rutherford Lost The Latest Round In The Custody Fight Against Her Husband
The last time I wrote about the trials and tribulations of Kelly Rutherford’s messy international custody fight, a judge in Monaco rejected a California judge’s order which gave her the right to bring her children, Hermes and Helena, back to the US. The judge in Monaco ruled that the California judge can’t decide shit since they don’t have jurisdiction over the case. As everyone knows by now since this story has been dragged out for years, Hermes and Helena currently live in Monaco with their dad and Kelly’s German citizen ex-husband Daniel Giersch. Daniel can’t live in the US, because his Visa was revoked. His Visa was revoked after someone in Kelly’s legal team reported his company’s alleged shady ways to the State Department. Kelly has always denied that. Since the last time I wrote about this mess, Kelly was able to bring her children to NYC for the summer. But summer may end early, because there’s a chance she’ll have to send them back to Monaco.
Kelly Rutherford’s Kids Are Staying In Monaco For Now
If I’m going to write about the never-ending trials and tribulations of Kelly Rutherford’s wreck of a custody fight, I may as well post a picture of her posing to next to a gorgeous, glamorous and insane-looking Dr. Kimberly Shaw.
As expected, a judge in Monaco spit at a California’s judge’s order that allowed Kelly Rutherford to bring her kids, Hermes and Helena, back to the US. If you haven’t been following this mess that’s an even bigger mess than Grace of Monaco (yes, I watched that elegant yawn and let’s not ever speak of it), let me give you the gist of it. Just picture Kelly and her ex Daniel Giersch practically yanking their kids arms off while using them as the rope in a never-ending game of tug o’ war. That’s pretty much what’s going on.
Kelly’s kids currently live in Monaco with their dad, because his US Visa was revoked. Last week, Kelly went to Monaco to visit them, but Daniel refused to let her see them until she handed over their US passports. Kelly told TMZ in an interview that anybody who brings her kids back to the US will be an American hero. So Daniel cried that he’s afraid she will kidnap their kids and asked her to hand over their passports to a third-party. Kelly’s lawyer went to court in L.A. and argued that Daniel is violating their agreement by not letting her see their kids. The judge in CA sided with Kelly. The judge declared that Kelly can bring Hermes and Helen back to CA. Kelly just needed an okay from Monaco to make that happen, but she didn’t get that okay.
The Associated Press says that Monaco currently has jurisdiction in the case and a judge ruled that the judge in California may not be aware of that. The judge in CA and the judge in Monaco will talk it out in a phone conference that’s supposed to happen on June 11th.
I was going to say that Kelly should just raise the white flag and move to Monaco. If there’s a community theater scene in Monaco, she can be the queen of it!. But then I read that relocating to Monaco isn’t that easy. You have to prove that you shit diamonds, basically. You have to deposit a bunch of money into a bank in Monaco. Kelly declared bankruptcy and says she’s gone broke from fighting her ex, so that may be out. Let the messiness continue, I guess.
