Kroy Biermann Is Asking The Judge To Kick Kim Zolciak Out Of Their Home Amid Their Divorce

The divorce of Kim Zolciak and Kroy Biermann, formerly of The Real Housewives of Atlanta and Don’t Be Tardy, only began last month, and it already has everything: a custody brawl, reefer madness, compulsive gambling, used wigs for sale, password changing, and sadly–abuse allegations. Through it all, the two have insisted on staying in their marital home (which may or not be on the brink of foreclosure) out of financial necessity. But now, Kroy decided he’s had enough and asked a judge to boot Kim out, and has also asked the court to appoint their four kids with a guardian ad litem since they’ve borne witness to this whole circus.

According to The Blast, former Atlanta Falcon Kroy, 37, wants sole custody of the kids (although Kim, “45,” does, too) and claims that he’s been the one taking care of them in the tacky Alpharetta, GA McManse, so he’s asking the judge to make her take her gruff smoker’s voice, Solo Cups, and Party City wigs and git.

According to legal documents, obtained by The Blast, Biermann claims he has been living in the home with their four minor children. So, he is asking a judge to be “awarded exclusive, temporary, and permanent use and possession of the marital residence…in Alpharetta, Georgia.” If that wasn’t clear enough, Kroy is asking for Zolciak to be… “restrained and enjoined from coming about the marital residence.”

The filing is a response from Biermann after his soon-to-be ex-wife, Zolciak went ahead and filed for full custody of the four minor children they share together. We broke the story, Zolciak’s new petition is clear she wants physical custody of the kids. We are guessing, whoever gains control of the house, will get custody of the kids.

At least it seems Kroy realizes this whole divorce and custody battle is a white-hot dumpster fire because he’s also asked the court to provide his and Kim’s kids with a guardian ad litem. via Us Weekly:

In the latest filing, Biermann asked the court to appoint a guardian ad litem (GAL) during his and the Real Housewives of Atlanta alum’s custody battle for their four children: Kroy Jr., 11, Kash, 10, and twins Kane and Kaia, 9. Biermann previously adopted Zolciak-Biermann’s two daughters from previous relationships: Brielle, 26, and Ariana, 21. The guardian, which can be an attorney or mental health professional, acts as a child’s voice throughout the case and is tasked with acting in the child’s best interest.

With all these attorney fees Kroy’s racking up, no wonder the repo man just came for their Rolls Royce. It’s well-documented that these two have negative dollars after living the high life on failed reality show checks and an uneventful NFL stint, so it’s odd that either of them would want to take on those money-hemorrhaging digs rather than finding two lower-priced homes to fuck off to with some dignity. But despite the seemingly obvious thing to do, best believe that as we speak, Kim’s chanting “ask, believe, receive” over a pile of scratch-offs and a pack of Marlbs while sitting at a convenience store poker machine, because getting awarded both the kids AND the house would be the ultimate gambling high!
