Josh Duggar’s Legal Team Is Trying To Keep His Former Molestation Case Out Of His Child Porn Trial

Josh Duggar’s legal team is doing the absolute most to make their client not look like a creep of the highest order. And so far, it’s not exactly working. Back in April, Josh was charged with receiving and possessing child pornography, the details of which, according to court documents and a Homeland Security Investigations Special Agent, are extremely upsetting. Josh’s lawyers tried to get the case dismissed on a technicality, saying there wasn’t enough evidence. When that didn’t work, they tried to get evidence thrown out, saying that a picture of his hands was taken without a warrant (court denied that one too). Now his lawyers are trying to make sure the jury knows absolutely nothing about Josh’s well-established past as a child molester.
Josh Duggar’s child porn trial is set to begin on November 30th in Arkansas. The prosecution will bring forth as much evidence as they got, and Josh’s lawyers will defend himself against the allegations that he was downloading and possessing explicit images featuring babies and children. Probably the best piece of evidence the prosecution could slide in front of that jury is a transcript of Josh’s parents openly confirming to Megyn Kelly back in 2015 that their son molested his sisters when they were kids. Kind of appears to be a pattern there, you know? But Josh’s lawyers really don’t want that extremely relevant fact brought up in court, and they’re filing a motion to have it excluded. via People magazine:
The criminal proceeding is not Duggar’s first legal controversy. In May 2015, the 19 Kids and Counting alum apologized for his “wrongdoing” after a 2006 police report revealed that he had been investigated as a teen for inappropriately touching five underage girls. His sisters Jill Dillard, 30, and Jessa Seewald, 29, subsequently stepped forward as two of the victims. Last week, the prosecution in his current case provided a notice to the defense that they may introduce evidence of Duggar’s 2000s molestation scandal in the trial.
This comes after the prosecution revealed last week that they were considering presenting Josh’s molestation situation as evidence, because – wait for it – they believe it shows a pattern of behavior and implies there’s an “unusual disposition” in the defendant. Essentially, if it walks like a pedo and it quacks like a pedo. You get the idea. They also argued that the evidence would be relevant because there’s one major connection: they both involve minor female victims. As well, the prosecution notes that his molestation situation was from just 15 years ago, and it was only made public six years ago, which they believe doesn’t make it a dusty piece of evidence desperately dug up in Josh’s past.
Josh’s lawyers responded to that saying the molestation actually happened 18 years ago when Josh was a minor, so they think it’s both too old and Josh was too young for it to count:
“Specifically, an allegation concerning alleged conduct by Duggar as a juvenile sheds no light on whether Duggar knowingly received or possessed alleged child pornography on three days in 2019 as the indictment alleges.”
The prosecution also mentioned that they may be presenting Josh’s old apology statement from 2015 as evidence. It’s the one where he admitted to being the “biggest hypocrite ever,” and revealed he had “secretly over the last several years been viewing pornography” and was living a “double life.” Josh’s lawyers responded to that saying it too was irrelevant to the case, and that Josh was admitting that he was viewing adult pornography, which isn’t the same as child porn. True. But he’s also admitting that he’s a sneaky creep who would hide things from his wife in order to maintain his Perfect Evangelical Christian Husband brand and keep those TLC checks coming in.
A pre-trial hearing is set for next Thursday, so Josh’s lawyers have a little over a week to prepare for that. They’re probably wiping flop sweat off their brows while begging Josh to tell them if there’s anything else out there that makes him look super guilty. “You didn’t ever write an unpublished manuscript called ‘Don’t Let Me Near A Laptop’, did you???”
