A Judge Dismissed The Case From One Of Kevin Spacey’s Accusers, But Anthony Rapp’s Case Still Stands

Oscar-winning actor and prolific pervert Kevin Spacey is being sued for sexual misconduct in the ’80s by actor Anthony Rapp and an unnamed accuser, both of whom were 14 years old at the time of their alleged assaults. But yesterday U.S. District Judge Lewis Kaplan dismissed all claims by the anonymous plaintiff because the man, known only as “C.D.”, wasn’t willing to reveal his identity. C.D.’s lawyers said he didn’t want “sudden unwanted attention”, which would be “simply too much for him to bear.” Their argument didn’t sway the judge. Anthony Rapp’s case will still stand, and while C.D.’s lawyer, Peter Saghir, declined to comment, he has suggested that his client might appeal if his case was severed from Anthony’s. Sigh. Good luck, C.D. That Spacey is more slippery than a drunk fish dipped in Vaseline.

The judge’s dismissal is no surprise; early last month Judge Kaplan ruled that C.D. would need to disclose his identity if he wanted the case to move forward. Judge Kaplan said the plaintiff’s need for privacy did not outweigh the “presumption of open judicial proceedings” and the “prejudice to Spacey’s defense that would occur if he could proceed anonymously.” Meaning, um… it’s unfair to Kevin’s side if all the details in a celebrity sexual assault case aren’t open to the public? The judge added that if C.D.’s name wasn’t revealed, it might prevent people who had information on the case “who might support Spacey” (snort) from coming forward.

The judge also said that C.D. (anonymously) taking part in a 2017 interview with New York magazine proved that he already took the risk of revealing his true identity. Judge Kaplan didn’t seem to care that C.D.’s lawyers argued doing so would trigger the plaintiff’s PTSD and “anxiety, nightmares, and depression.” The alleged assault against C.D. occurred in 1983 when the 14-year-old was taking one of Kevin’s acting classes in the New York burbs. He says their “sexual relationship” ended when he resisted then-24-year-old Kevin’s attempts to penetrate him.

Well, if Judge Kaplan isn’t worried about C.D. being bashed in the public eye, let’s bring up his past, shall we? Last year 200 lawyers submitted a judicial complaint aimed at the 76-year-old judge, which claimed Kaplan committed “a series of shocking violations of the judicial code of conduct” against human rights lawyer Steven Donziger, who helped Indigenous peoples win a case against Chevron for dumping oil waste in the Amazon. Kaplan also allegedly helped the accounting firm KPMG wiggle out of corporate fraud charges that saved them a couple of billion dollars in pesky taxes. So people think this dude is in the pockets of Big Oil and Wall Street. And now he’s Team Kevin Spacey? Blegh. Can we please switch to Judges Judy, Mathis, or Reinhold?
