Nick Loeb Has Lost His Fight For Sofia Vergara’s Embryos In Louisiana, Again

Nick Loeb has established himself as the kind whose relevancy should forever be limited to sub-basement level Tomatometer scores, and yet, it’s not, because Nick Loeb is still messing with Sofia Vergara and trying to get the embryos they made when they were together. But the good news for Sofia is that those embryos continue to be protected for now, because Nick has once again felt the reproductive justice wrath of a Louisiana appeals court.

This embryo battle in 2015 when Sofia and Nick called it quits after four years off-and-on together, two of which were spent engaged to each other. A year after they broke up, Nick sued Sofia for embryos they had frozen together and had planned to use. But after they split, Nick wanted to turn the embryos into children and Sofia did not want that. Sofia wants to keep the embryos frozen forever and believes Nick should move on. Nick pulled at the heartstrings of the pro-life crowd by writing an op-ed in 2015 for The New York Times, begging for the chance to become a papa, then filing for custody of the embryos, which he was calling “Emma” and “Isabella.” Sofia called bullshit on Nick’s pro-life stance, accusing him of having two ex-girlfriends who had abortions. A judge demanded that Nick name his ex-girlfriends, which he refused to do, so he dropped his lawsuit.

Nick’s lawsuit was originally filed in California. That’s when Nick had the evil genius idea to try to get the embryos moved to Louisiana, which is considered a “safe haven” state for embryos. Nick has claimed that he lives in Louisiana, which would have worked, had he been able to show the court some proof of residency. He could not, and in 2019, a Louisiana judge ruled against him.

Nick appealed the Louisiana judge’s judgement. And cue up the losing horn from The Price is Right, because Nick lost again. And this time, things might get worse for him, because the court has ruled that all documents from their case be unsealed. via Page Six:

An appeals court has ruled that Loeb’s case should be tossed and that it made a “mockery of the Louisiana legal system.” The court also slammed Loeb’s filing in Louisiana as “abhorrent,” and ruled that all documents in the case be unsealed.

Once again, the appeals court argued that Nick Loeb has done absolutely nothing to prove he’s a resident of Louisiana and that it’s pretty clear he isn’t. To be fair, it wasn’t a great strategy for Nick. My mind, body, and spirit are permanently in Margaritaville, but I can’t claim residence there. The appeals court also accused Nick of “forum shopping” when he picked the Plaquemines Parish area to file his lawsuit.

“Furthermore, based on all of the facts…it is clear that Mr. Loeb blatantly engaged in forum shopping when he selected Plaquemines Parish to file the instant lawsuit, with full knowledge that it was the improper venue. Their behavior brings disrepute to and makes a mockery of the Louisiana legal system and the bar and is abhorrent.”

So I guess you could say that The Big Easy proved to be a very difficult foe for Nick’s embryo scam. There’s always California. There is still a lawsuit pending in California, filed by Sofia in 2017, where she is seeking a permanent injunction to prevent Nick from bringing the embryos to term without her written consent. And he’s never going to get that. Nick might be officially fucked. I could see him trying to file another lawsuit in some other state. But what state even? At this point, he’s a permanent resident of the state of delusion, but you can’t file a lawsuit there.
