Kristin Cavallari and Jay Cutler ripped the bandage off and decided to go through with a divorce right in the middle of a pandemic instead of waiting for the lockdown to end. But I guess that shit is so bad that even coronavirus can’t stop them from wanting to be done with each other. Jay is the one who filed for divorce and in Kristin’s response, she listed “marital misconduct” as the reason for why their marriage ended. That caused some to look squarely at Jay’s peen for wandering (and there’s a rumor that they have both recently accused the other of cheating), but TMZ claims they’re not fighting over a marriage-ruining hussy. But they may be fighting over child custody.
TMZ claims that Kristin listing “marital misconduct” on her divorce filing has nothing to do with cheating, or that storyline on her reality show Very Cavallari which involved an accusation that Jay cheated on her with her ex-BFF Kelly Henderson. It seems the real “marital misconduct” tea is just legalese.
Tennessee is a “fault state” — meaning someone asking for a divorce must show fault on the part of the other spouse, and that’s why she claimed Jay is guilty of “marital misconduct.” It’s actually boilerplate language in the state. The language is included in a divorce petition and counterclaim because Kristin and Jay can’t end the marriage without some showing of misconduct. As for what the misconduct is … that’s for the lawyers to handle.
However there is a bit of tension in regards to their three children, Camden Jack, Jaxon Wyatt, and Saylor James. Sources tell TMZ that Kristin was “surprised” when Jay filed for divorce first and that the only thing she was curious about on the divorce petition was his claim he is the “primary caretaker” and “at-home parent”. Kristin says she is the primary caregiver and asked for primary custody with Jay getting visitation. Jay is asking for joint custody. TMZ reached out to Kristin’s lawyer, Rose Palermo, who referred them to her original divorce announcement Instagram post.
When Kristin and Jay announced their divorce, they said that their marriage had come to a “loving conclusion.” My guess is that what they meant is that they’re loving that their shit marriage has finally come to a conclusion. Things probably really ended when one of the kids got a headache and when Jay gave the kid some stuff like Tylenol, anti-vaxxing princess Kristin screamed, “You’re giving our kid autism pills!!!! It’s over!”
