Kristin Cavallari And Jay Cutler Are Done And She Accused Him Of “Marital Misconduct” In Divorce Papers

Well, I guess you could say their marriage wasn’t immune to a divorce! There, now that the obvious anti-vaxx joke is out of my system, let’s talk about Kristin Cavallari and Jay Cutler’s divorce announcement.

33-year-old Kristin broke the news yesterday on Instagram with a picture of herself and 36-year-old Jay and explained in the caption that they have come to the “loving conclusion” to get a divorce. Science’s nemesis and the retired professional ball-thrower started dating in 2010, and got married in Nashville in June 2013. They have three kids together: 7-year-old Camden Jack, 5-year-old Jaxon Wyatt, and 4-year-old Saylor James.

Basically, Kristin is saying: “My marriage is dunzo!

The fact that Kristin specifically said they’re getting a divorce, and not that they’re just separated for now makes it clear their marriage is probably over. But for a long-term reality star like Kristin, the real proof is in her Instagram bio. Kristin has removed “wife” from her bio, and now it simply reads that she’s a Momma, the Founder + CEO of Uncommon James (her jewelry company), and a two-time New York Times best-selling author. Jay Cutler also posted on his Instagram account with the same message, that they grew apart, and that they’re asking for privacy at this time.

Okay, but now it’s time to whisper suspiciously about the alleged reasons for why they’re getting a divorce. One source tells E! News that Kristin and Jay have been trying to “make it work” for a while now. E! also points out that in the third (and most recent) season of Kristin’s E! reality series, Very Cavallari, Jay got pulled into a storyline that involved allegations of him cheating with Kristin’s former best friend, Kelly Henderson. Jay denied anything happened, and Kristin swore she didn’t believe the rumors. One source who spoke to People magazine echoes what E!’s source said, which is that Kristin and Jay have been struggling for a while and that they hadn’t spent that much time together in recent months. People’s source also says that the cheating rumors between Jay and Kelly had nothing to do with their decision to divorce.

But then TMZ comes along like, “Did someone say cheating rumors?“. They got a hold of Kristin’s response to Jay’s divorce filing and claimed that he’s guilty of shady business that messed up their marriage, and he may have accused her of the same thing.

Kristin has filed legal docs, obtained by TMZ, in which she alleges “misconduct” on the part of Jay and claims that’s what triggered the divorce. She says Jay “is guilty of such inappropriate marital conduct as renders further cohabitation unsafe and improper.”

Kristin also insinuates Jay has accused her of misconduct … “any misconduct alleged or implied against her in the complaint for divorce was in response to and/or as a result of misconduct on behalf of the Husband.” Jay, who filed for divorce, never mentioned “misconduct” against Kristin in his petition.

Kristin says the grounds for divorce are both “inappropriate marital conduct” and “irreconcilable differences.”

Kristin is asking for primary physical custody of their three children, and will allow visitation for Jay. In her divorce response, Kristin implies that Jay is a bit of a no-show daddy who really isn’t home with the kids that much. Jay, on the other hand, has reportedly requested joint custody. Kristin has also reportedly asked for child support, health insurance for the kids, and that Jay maintain a life insurance policy in which she is listed as the sole beneficiary.

And, according to a source who spoke with People, Kristin and Jay had been planning to announce their divorce when things quieted down a little after being “trapped” in the Bahamas last month during the beginning of the COVID-19 pandemic. Everyone jokes that married couples are going to come out of COVID-19 quarantine and head straight for a divorce lawyer’s office. But at least the coronavirus can say, “Sure, I split a lot of people up, but let’s be honest – those two didn’t need any help from me.
