Federal Court Denied Kelly Rutherford’s Request To Bring Her Kids Back To The US

You’re probably thinking, who needs kids when you have a hoity-toity, snobby ass, fluffy white purse dog whose name is probably Countess Chanel de la Fancy? Well, Kelly Rutherford needs and wants her kids back in the US with her, but it looks like that’s not going to happen anytime soon.

If you haven’t been keeping up with the tragically messy custody battle between Kelly Rutherford (aka Megan the hooker with the heart of gold from Melrose Place) and her ex-husband Daniel Giersch, let me sum it up for you with one simple GIF:

The messiness started in 2008 when Kelly and Daniel’s marriage tanked while she was knocked up with their second kid. She accused him of passing his peen to others during their marriage, so she filed for divorce. Things immediately got messier. She also accused him of harassing her and causing her stress and they fought over the custody of their kids, Hermes and Helena (who are now 8 and 5). Kelly didn’t put his name on their daughter’s birth certificate and she told the court that she was afraid he was going to kidnap their kids. In 2010, the messiness died down a bit when the court declared that the kids would live with Kelly and Daniel would get visitation rights. But the fuckery came back in full force two years later when German-born Daniel’s visa was revoked and he was deported. The rumor is that Kelly’s lawyer told the State Department that Daniel’s company was into some shady shit including fraud and drug dealing. The State Department found enough evidence to kick Daniel out of the country.

Since Daniel was forced to move back to Monaco and couldn’t come back to the US, a judge ruled that Hermes and Helena should live with him. So Hermes and Helena were pulled out of their mother’s house in NYC and taken to Monaco where they’ve been living since 2012. Kelly gets her kids every summer, but she wants them to live in the US all the time. She’s been fighting ever since and claims she had to declare bankruptcy in 2013 because she went broke from paying legal bills and going to Monaco all the time. Kelly and Daniel’s custody fight went all the way to the federal level where she argued for her children’s constitutional rights as U.S. citizens. The federal court shut down her request to bring her children back to the US. The court said that her children haven’t been deported and when they get older, they can choose to live in the US if they want. A California court told Daniel to keep applying for a visa, but the State Department says he hasn’t done that yet.

Kelly went on Good Morning America where she said that she’s going to keep fighting:

“I know it’s not right. Parents know — everyone knows it’s not right. I can sit here and tell you how often I cry. I can tell you how it feels to leave my kids in a foreign country and seeing them after not seeing them for weeks on end. Not being able to bring them from school and pick them up from school, dress them, hug them, smell them.

I told my son, ‘Mommy is still fighting for you.’ My children, not only were they taken away, but they were sent to a foreign country. I don’t even know how you explain to someone what it feels like.”

There are two sides to every story and it sounds like both sides of this story are a mess. But it sounds to me like Kelly played dirty and lost majorly. If the rumors are true, she probably thought that Daniel would be deported or arrested and she’d have the kids all to herself, but that blew up in her face. That saddens me. I mean, Kelly was on an Aaron Spelling primetime soap opera and she learned absolutely nothing about how to scheme and scheme well. Amanda Woodward would never!
