A Judge Sent Kelly Rutherford’s Kids Back To Their Father In Monaco
“I swear, if her check bounces again, I’m done.” – Kelly Rutherford’s lawyer in that picture, probably.
Kelly Rutherford was ordered to show her face in a courtroom in NYC this morning after she refused to send her two children, Hermes and Helena, back to Monaco where they live with their dad Daniel Giersch. Kelly got to keep her kids in NYC for the summer, but when it came time to put them on a plane to Monaco, she said “fuck no” and kept them. Both California and New York rejected Kelly’s custody case, because they say that Monaco has jurisdiction. Kelly argued that since no state in the US has ordered her to return her children, she’s going to keep them and will not send them to Europe. Well, that changed today, because a court in NYC did order her to send them back to Monaco.
After Kelly made it clear that she wasn’t going to return her kids to their dad, Daniel’s lawyer accused her of kidnapping and called for an emergency hearing. Kelly was supposed to show up to the hearing with her children, but she didn’t. Her lawyer told the judge that Kelly didn’t want to expose them to all the paparazzi and media outside of the courthouse, so they didn’t bring them. Judge Ellen Frances Gesmer was not amused and ordered for the children to be brought in. The children showed up in the courtroom shortly after. The media wasn’t allowed inside, but People says that Judge Ellen didn’t want to hear what Kelly had to say and ordered for the kids to go back to Monaco. Daniel’s mother was in the courtroom and she and the children immediately left for the airport.
Gesmer said she did not “look kindly upon” Rutherford’s failure to comply with the order requiring the children’s presence. When Rutherford tried to address the judge directly, Gesmer shut her down.
Ultimately, Helena and Hermes were once more ordered to say goodbye to their mother in the courthouse and left with their grandmother en route to Monaco. A member of Giersch’s legal team tells PEOPLE the children were heard speaking in their dual tongues of English and French as they reunited with their grandmother.
Another hearing will go down on September 3rd in Monaco.
When I first heard that Kelly refused to return her kids to their dad, I figured that maybe just maybe she’d go full Lifetime movie by smuggling her kids out of the country to a desolate foreign land where she’d change their names, dye their hair, teach them a new language and they’d all live on a goat farm. Maybe Kelly knew that she’d eventually have to send her children back to Monaco, but was trying to make a point by keeping them and knew her plight would get even more attention. I fully expect to hear that Kelly was escorted off the tarmac at JFK by police after she laid down in front of the plane’s wheels while wrapped in an American flag.
